For auctioneersHow to Start an Auction Business: Licensing, Costs and First Sale
To start an auction business, pick a niche you can source steadily (estates, liquidation or consignments), get any license your state requires (in Texas, from TDLR), set up your business and sales tax permit, write clear terms, choose online auction software, and run a small first sale to learn the work before you scale.
What kind of auction business should you start?
Choose by where your inventory will come from, because steady supply is the hardest part of the business. Each niche runs differently day to day, needs different space, and attracts a different kind of bidder.
- Estate auctions: one household at a time, sold on site or moved to your space, with a family or executor as your client.
- Liquidation and returns: pallets of customer returns and overstock, bought outright and sold weekly in volume.
- Consignment: items from many sellers, gathered into regular general sales.
- Specialty: tools, equipment, collectibles or vehicles, where your knowledge earns trust.
Do you need a license to run auctions?
In many states, yes. In Texas, auctioneers are licensed by the Texas Department of Licensing and Regulation (TDLR), which sets the education, exam and fee requirements and any exemptions. Other states differ, so check your own state's rules.
Read TDLR's auctioneer program pages, or your state licensing agency's, before you advertise a sale. This page is general information, not legal advice.
What business setup do you need?
Form your business entity, insure your space and the goods you hold, and open a separate bank account so auction money never mixes with personal money. If you sell taxable goods, you will generally need a sales tax permit too.
In Texas, sales tax is 6.25% state plus up to 2% local, so up to 8.25%. When you buy inventory to resell, such as liquidation pallets, a Texas resale certificate (Form 01-339) generally lets you buy it without paying tax; see our guide to resale certificates at auctions. Confirm the details with the Texas Comptroller or an accountant.
How much does it cost to start an auction business?
Costs depend mostly on space and inventory. A consignment or estate business can start with a vehicle, a phone camera, folding tables and software, because you don't buy the goods. A liquidation business needs cash for pallets and a warehouse to sort them in.
Software can grow with you. On Auktia, a one-time sale on the Pinch Hitter plan costs $100 plus a share of what sells, never more than $500, and monthly plans start at $49.99 plus 3% of hammer. See the pricing details.
How do auction businesses make money?
Revenue usually comes from two sides. Buyers pay a buyer's premium on top of the hammer, and consignors pay a commission out of what their items bring. Liquidation houses that buy stock outright keep the margin between their cost and the hammer instead.
A worked example: a $20,000 consignment sale with a 15% buyer's premium brings in $3,000 from buyers. If your consignor commission is 25%, that adds $5,000, for $8,000 before software, card processing, labor and rent. Your rates may differ; the point is to know them before the first sale.
How do you run your first auction?
The first sale is for learning the workflow, so keep it small enough that a mistake is cheap. Our guide to running an online auction covers each stage.
- Start with 50 to 150 lots you know well.
- Write your terms: premium, payment deadline, pickup times and remove-by date.
- Catalog with honest condition notes and real photos.
- Run a timed online sale over about a week.
- Invoice fast, run an orderly pickup, and note what slowed you down.
Questions people ask
Is an auction business profitable?
It can be, when supply is steady and costs are controlled. Income comes from premium and commission, or the spread on stock you own, minus labor, rent, software and payment costs, so track every sale's numbers from the start.
Can I start an auction business without a warehouse?
Yes. Estate and consignment sales can run online with pickup at the seller's location, so you only need space once volume grows. Check local zoning and lease rules before inviting buyers to any address.
Do I need a sales tax permit to run auctions?
Generally, if you sell taxable goods in Texas, yes: a sales and use tax permit from the Texas Comptroller. Ask an accountant how it applies to your setup.
What software do I need to start?
One platform that catalogs, runs timed bidding, takes card payments and handles invoices is enough to begin, plus accounting software for the books. Compare options in our guide to online auction software.
Where do auction houses find inventory?
Estate work often comes through referrals from attorneys, real estate agents and families; liquidation stock from sellers of returns and overstock; consignments from local advertising and repeat sellers. Build the pipeline before the first sale.
How long does it take to start an auction business?
Plan around licensing first, since education and an exam take time where they are required. Entity setup, a tax permit, written terms and software can all happen alongside it.
